What an Expungement Can and Cannot Do

  1. Creates a new court entry reflecting dismissal of the case.
  2. Allows many private job applications to be answered as though you have not been convicted (with important exceptions).
  3. May limit use of the conviction to impeach you as a witness in many situations.
  4. For certain felonies, can be an important first step toward a pardon.
  1. It does not erase your DOJ/FBI criminal history (“rap sheet”); it shows the conviction and later dismissal.
  2. It does not automatically restore firearm rights if they were lost (separate rules may apply).
  3. It does not automatically end sex-offender registration obligations; other relief may be required where eligible.
  4. It does not allow omission on applications for government-issued licenses, permits, or security clearances.
  5. It does not seal the court file from public view in most cases.
  6. It does not prevent the conviction from being used as a prior/strike where legally permitted.
